This privacy policy provides you with a clear and precise presentation of which personal data may be collected when browsing our Website. We are committed to respecting the privacy of our Users. We also explain below the conditions under which your personal data may be used, disclosed, transferred and/or stored.

 

I – DATA PROCESSING

Definitions

“RT”: Concerning the data collected via the site’s contact form, the Data Processing Manager is the French company BIOPHA, located at Parc d’Activité Sud Loire -BOUFFÉRÉ – 85 612 MONTAIGU Cedex, registered in the Trade and Companies Register of LA ROCHE SUR YON, under number 328 835 905. Concerning the data collected via registration to the newsletter, the Data Processing Manager is the French company INSTITUT DE RECHERCHE BIOLOGIQUE – IRB, located at Parc d’Activité Sud Loire – BOUFFÉRÉ – 85 612 MONTAIGU Cedex, registered in the Trade and Companies Register of LA ROCHE SUR YON, under number 315 249 821.
“Website”: refers to the website biolane.fr developed by the company LATELIER.
“Host”: refers to the company OCEANET TECHNOLOGY, located at 2, Impasse Joséphine Baker, 44 800 Saint Herblain, where the Website is hosted, as well as the personal data collected from users via the Contact form.
“Users”: refers to all natural persons and adults who access the content of the Website and its functionalities.
“Data” means any information relating to an identified or identifiable natural person, collected via the “Contact” form accessible on the Website or via subscription to the newsletter.

Data collected via the contact form

The data collected via the contact form of the Website are: courtesy, surname, first name and email address. They are mandatory and legitimate for the RT to be able to respond to requests for information made by the User via this form. The legal basis for this processing is the legitimate interest of the RT to be able to reply to the User. If this information is not provided, the User will not be able to send his question and will therefore not receive a reply.
The data collected, postal address, postal code and city are optional and allow the RT to send product samples to the Internet user. The legal basis for this processing is the consent given by the Internet user requesting to receive samples produced. In the event that this information is not provided, the Internet user will not be able to receive product samples. Conversely, in the event that the Internet user provides this data, he may at any time withdraw this consent, without justification, by simply writing to privacy@ponroy.com.
These data are intended for the RT (controller) and the Host (subcontractor).
The RT will process personal data for the purpose of responding to requests for information from Users or, in the context of a request for samples, to send the samples produced to the postal addresses indicated.

Data collected via Newsletter

The data collected from the email address is optional and allows the RT to send a newsletter to the Internet user by email. The legal basis for this processing is the consent given by the Internet user wishing to receive the RT newsletter. In the event of failure to provide the email address, the user will not be able to receive the user’s newsletter. Conversely, in the event of information of this data by the Internet user, he/she may at any time withdraw this consent, without justification, by simply writing to privacy@ponroy.com or by clicking on the hypertext link contained in the newsletter allowing him/her to unsubscribe with one click.
These data are intended for the RT and the Host (subcontractor).
The RT will process personal data for the purpose of sending a newsletter about the products of the Website.

 

Data destination

Data collected and processed via the Website are exclusively hosted and processed in France, or within the European Union.
The said data, collected as part of the Website’s Contact form or as part of the newsletter subscription, will be used in accordance with the provisions of Regulation 2016/679 of 27 April 2016, the “Data Protection Act” No. 78-17 of 06 January 1978 and the Law for a Digital Republic of 7 October 2016.

 

Data retention

The RT will store the personal data collected via the contact form during the processing of the request and then the RT will delete them.
The RT will keep the personal data collected via the newsletter subscription for as long as the User uses the services of the Website and at the latest three (3) years after their last contact (example: last click on the hypertext link contained in the newsletter leading the User to navigate on the Website).

Users’ rights

The User has a right of access, rectification, deletion, opposition, data management after death, limitation or portability of the data provided by sending an email with a photocopy of an identity document to privacy@ponroy.com.
The CBRs undertake to respond to any request to exercise Users’ rights within one (1) month of receipt of the request. However, in the event that the User whose data has been collected deems it necessary, he/she may lodge a complaint with the CNIL, the supervisory authority https://www.cnil.fr/fr/plaintes.

Data security

The SRs have implemented technical and organisational measures to preserve the confidentiality and security of Users’ Data and in particular to prevent it from being distorted, damaged, destroyed or accessed by unauthorised third parties.
The SRs make every effort to provide Users with available and verified information and/or tools, but shall not be held liable for errors (in particular posting on the Website, sending incorrect e-mails), lack of availability of information and/or the presence of viruses on the Website or on websites to which the Website is redirected, any malfunction of the Internet network preventing the proper functioning of the Website (in particular due to external malicious acts); interruptions, data transmission delays, terminal failures, failures of the User’s telephone line, servers, Internet service providers, telephone operators, computer equipment, software; the loss of any electronic mail and, more generally, the loss of any data, the consequences of any virus, computer bug, anomaly, technical failure, any damage caused to a User’s terminal, any technical, hardware and software failure of any kind, having prevented or limited the possibility of using the Website or having damaged a User’s system.
It is the responsibility of any User to take all appropriate measures to protect his own data and/or software stored on his equipment against any breach. The connection of any person to the Website is under their sole responsibility.
Similarly, the use of the Website implies knowledge and acceptance of the characteristics and limits of the Internet, the lack of protection of certain data against possible misappropriation or hacking and the risk of contamination by possible viruses circulating on the network.

Users declare and acknowledge that they are aware of the characteristics, risks and constraints of the Internet and in particular that data and information transmissions on the Internet benefit only from relative technical reliability, as they circulate on heterogeneous networks with various characteristics and technical capacities that disrupt access or make it impossible at certain times. Users acknowledge that the Website may be subject to unauthorized third-party intrusion and that information circulating on the Internet (personal data or not) is only relatively protected against possible misappropriation (free access) and possible viruses.

Acceptance of the privacy policy

What is a cookie ?

Cookies storage

Cookies will be limited to a lifetime of thirteen (13) months in the User’s terminal from the time the User has given his/her consent to the application of said cookie. Beyond that, the User will have to give his consent again.

III- APPLICABLE LAW AND COMPETENCE ATTRIBUTION

This privacy policy is governed by French law. In the event of a dispute and in the absence of an amicable agreement, the dispute shall be brought before the competent court and in the event of multiple choices, that within the jurisdiction of Nantes.
